✍️ Title XIII: National Security and Cybersecurity
Article 100 – The National Army
The Tunisian Army is republican, national, and neutral.
Its role is limited to the protection of the homeland, its sovereignty, independence, and territorial unity.
It shall not interfere in political affairs.
Article 101 – Internal Security
The internal security forces are responsible for protecting public order, ensuring the safety of citizens and their freedoms, in full respect of the Constitution, the law, and human rights.
Article 102 – The Supreme Council for Security and Defense
A Supreme Council for Security and Defense shall be established, chaired by the President of the Republic and composed of the Prime Minister, the Ministers of Defense, Interior, and Foreign Affairs, as well as the Speakers of the parliamentary chambers.
This Council is tasked with setting general policies for national security and ensuring coordination among State institutions in addressing threats.
Article 103 – Cybersecurity
Cybersecurity is an integral part of national security.
The State is committed to protecting the national digital space from threats and to developing cybersecurity infrastructure.
Article 104 – Protection of Rights in Security Emergencies
All security measures, including those related to cybersecurity, are subject to parliamentary and judicial oversight.
Under no circumstances may they infringe upon non-derogable rights.
