✍️ Title VIII: Local and Regional Governance

Article 62 – Principle of Decentralization
The system of decentralization is adopted within the framework of the unity of the Republic, through elected local and regional authorities endowed with legal personality as well as administrative and financial autonomy.

Article 63 – Powers of Local and Regional Authorities
Municipalities and regions are responsible for:

  • Managing basic public services,

  • Developing and implementing economic and social development plans,

  • Preparing and executing their budgets,

  • Protecting the environment and natural and cultural heritage.

Article 64 – Financial Resources
Local and regional authorities shall have their own resources, in addition to transfers from the State, based on the principles of national solidarity and regional balance.
They may not be subjected to any prior guardianship; oversight is limited to judicial review or ex-post control as defined by law.

Article 65 – Local Democracy
The principle of local democracy is guaranteed through free and transparent elections, fair representation of women, youth, and persons with disabilities, as well as the adoption of participatory mechanisms in local decision-making.

Article 66 – Local and International Cooperation
Local and regional authorities may cooperate among themselves, with the State, and with international organizations and institutions, in accordance with the law and with full respect for national sovereignty.

Article 67 – Dissolution of Councils
Local and regional councils may only be dissolved by a final judicial decision, under conditions defined by law.
